Long story short.

4 years ago, I won new phone but along came a new contract. I sent it back to where it came from.
Months later I get a grand total bill of 400 dollars for a phone I never used or activated.

Collections is telling me i HAVE to pay it because I verbally consented to the new phone thus consenting to the new contract.

I have all original documents stating if i use it or sign it I would be liable for all charges incurred.

I am REFUSING to pay it. I am NOT paying for a service I never signed or used.
I went around circles with Bell Mobility and with no luck.

How is this going to affect my credit if I don't pay.

I don't even own a credit card!

It could hurt your chances at securing loans and mortgages etc. When did you send it back? You should've had 15 or 30 days buyer's remorse or something like that.

do you have proof that you mailed it back to them?

ask them to hear their proof of you consenting on the phone. If they dont have you on tape, they cant make you pay shxt.

Demand proof that you signed it or demand that they close the account, regardless of whether Bell wants to screw you around they cannot hold you to an unsigned contract. Period. If they refuse to do anything then ask the collector for his license number and inform him that you are going to make a ministry complaint and that you would also like his manager or district managers number. If he refuses or whatever send a registered piece of mail to the collections agency, making the same demands for proof of signature and license information. Be sure to include that you will only respond to letter mail and that you will consider it harassment if they call you again. Be sure to keep a copy of any and all documentation as well. If they call you after this they are breaking the law and you can sue them for damages. However you are by law supposed to provide one avenue of contact so if you hide your address from them, or whatever, they can get around this.

Collectors essentially only have the right to inform you of the debt and ask you to repay it. They are so regulated they basically can't do anything more than that, any threat of sueing you is illegal, telling you they are going to effect your credit is a misnomer because once a file is listed it will go on your credit report regardless. Be sure to demand the removal of any mark on your bureau and check your report 3 months later to be sure it was removed.

We are all allowed one free copy of our report from both equifax and transunion once per year.

This only applies of course on whether they got the phone back or not.
