That's great and all, but the cops don't care about people's rights if they think they're on to something. They'll search your car regardless. Your only recourse is to file a complaint or sue, but all the cop has to say is the driver was behaving suspiciously, that there was an odour of marijuana or alcohol, etc and your complaint dies.

If more people got to experience the joy of an illegal search, maybe there'd be more public outcry. Until then, the police will do pretty much whatever they think they can get away with.

I've sat through 4 searches. Two were legal because there was open alcohol in the car. Two were totally bogus, but the cops couldn't have cared less about my protests. They just made up 'reasonable grounds'. Next time, I'm gonna lock myself in the car and wait for a lawyer to show up.

what you need to do is grab your insurance papers, roll up the windows, get out of the car and lock your doors, and then speak to the officer

they'll grumble about wanting you back in the car 'for your safety' but they can't order you to do so

Once you're out of the car, they'll put you in the back of their car, take your keys and do whatever they want. If you're locked in the car, they'll have to break a window to get in, which is really escalating the situation, but at least there's evidence of their heavy-handedness.

I am a big fan of the police, if you have nothing to hide its no big deal. The last time the police searched my car it actually worked out in my favour.

Yeah, the vibe is apparently standing up for my rights. Cops don't like that.

And Esta, that whole "If you have nothing to hide, it's no big deal" is a joke. Would you feel that way if they came knocking at your door at 3:00am? "Hey, mind if we poke around?"

I have had cops in my place before, some were cool, others made me flush my weed. I have even had cops question why I had a baseball bat in my private residence, they are people and will act like people all over the board at times. Police asking permission to search my vehicle after they were convinced I committed a crime and some random cop showing up at my apartment wanting to get in for no reason are two different things.

That's the point though: what constitutes the police being "convinced" someone has committed a crime? It's too subjective, which is why there are rules laid out for them. The only way the cops will get the message is if the courts start tossing cases involving searches during "routine" traffic stops.
